Terms of Service

These terms govern your use of Watchover. They explain what the service does, its important limitations — including that it is read-only and cannot catch every scam — and the responsibilities you take on, such as having a loved one's consent before inviting them.

Acceptance of these terms

These Terms of Service (“Terms”) are a binding agreement between you and Watchover, Inc. (“Watchover,” “we,” “us”). They govern your use of the Watchover app, our website, the bank-connection flow we host for invited family members, and related services (the “Services”). By creating an account, connecting an account, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

What Watchover is

Watchover lets a person (the “protector”) invite a family member (a “loved one”) to connect their bank accounts so that Watchover can watch transactions for patterns associated with scams and for spending limits the protector configures, and notify the protector when something appears to warrant attention.

Watchover is a monitoring and notification tool. It is not a bank, a money transmitter, a financial advisor, a fraud-prevention guarantee, or a substitute for your own judgment or for contacting your financial institution.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

Important limitations — please read

Read this carefully

Watchover cannot catch every scam or every problematic transaction, and it may flag transactions that turn out to be legitimate. Detection is based on patterns and rules and is inherently imperfect. You should not rely on Watchover as your sole protection against fraud, and the absence of an alert does not mean a transaction is safe.

  • Read-only. Watchover accesses account information on a read-only basis. We cannot move money, make or stop payments, transfer funds, freeze cards, or change anything about a connected account.
  • Not financial or legal advice. Alerts and content are informational only.
  • You decide what to do. Watchover surfaces information; deciding whether and how to act — including contacting the bank or authorities — is up to you.
  • Delivery is not guaranteed. Notifications and text messages depend on third parties (carriers, push services, banks, and Plaid) and may be delayed or fail.

Your responsibilities

  • Provide accurate information and keep your account and device secure.
  • Use the Services only for lawful purposes and only as permitted by these Terms.
  • Do not attempt to access accounts you are not authorized to monitor, interfere with the Services, or reverse engineer or misuse them.
  • Promptly review alerts. You are responsible for the decisions and actions you take (or do not take) in response to them.

Plaid & other third-party services

The Services rely on third parties, including Plaid for bank connectivity, an SMS provider for invitations and one-time codes, and a push- notification provider. Your use of bank connections is also subject to Plaid's terms and privacy policies and to your financial institution's terms. We are not responsible for third-party services, and their availability or actions may affect the Services.

Your account & security

You sign in with a one-time code sent to your mobile number. You are responsible for keeping your phone and account secure and for all activity under your account. Notify us promptly at support@usewatchover.com if you suspect unauthorized use.

Beta service & availability

The Services may be offered as a beta or preview and may contain errors or change over time. We may add, modify, suspend, or discontinue features at any time, and we do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Intellectual property

The Services, including their software, design, and content, are owned by Watchover and its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or create derivative works except as permitted by law.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICES WILL DETECT ALL SCAMS, FRAUD, OR PROBLEMATIC TRANSACTIONS, OR THAT ALERTS WILL BE ACCURATE, TIMELY, OR DELIVERED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WATCHOVER AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, INCLUDING ANY SCAM OR TRANSACTION THE SERVICES DID NOT DETECT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

Indemnification

You agree to indemnify and hold Watchover harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of another — including inviting or monitoring a person without their consent.

Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Watchover agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to other agreement, except that either party may seek injunctive relief in any court of competent jurisdiction.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.

Termination

You may stop using the Services at any time; a protector may close their account and a loved one may disconnect at any time. We may suspend or terminate access if you violate these Terms or to protect the Services or other users. Sections that by their nature should survive termination — including disclaimers, limitation of liability, and indemnification — will survive.
